These Terms of Use ("Terms") govern your access to and use of the ATHETIC mobile application and website operated by PRODIST LLC ("Company", "We", "Us"). By accessing or using ATHETIC, you agree to be bound by these Terms.

2. Intellectual Property & Anti-Scraping Protection

All software code, 3D models, biomechanical algorithms, video guides, graphic interfaces, and brand trademarks associated with ATHETIC are the exclusive intellectual property of PRODIST LLC.

  • Prohibited Actions: Reverse engineering, decompilation, automated data scraping, framing, or unauthorized distribution of proprietary content is strictly prohibited.
  • Account Suspension & Legal Action: Unauthorized capture, scraping, or misuse of proprietary content may result in immediate permanent account suspension and legal prosecution under applicable United States federal and state laws.

3. In-App Subscriptions & StoreKit Billing Terms

ATHETIC offers VIP Access subscriptions billed via Apple App Store In-App Purchase (StoreKit) or Google Play Billing.

  • Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours prior to the end of the current billing cycle.
  • Management & Cancellation: You can manage or cancel your subscription at any time through your Apple ID or Google Play Account Settings. Refunds are handled directly by Apple or Google in accordance with their store policies.

4. User-Generated Content & Community Guidelines (Apple Guideline 1.2)

ATHETIC provides social community features where users may post workout stories, comments, and direct messages.

  • Zero Tolerance Policy: We enforce a strict zero-tolerance policy against abusive, harassing, defamatory, explicit, or unlawful content.
  • Content Moderation & Reporting: Flagged content will be reviewed and removed within 24 hours. Accounts violating community standards will be terminated immediately.

5. DMCA Copyright Policy & Takedown Notices

PRODIST LLC respects intellectual property rights. If you believe your copyrighted work has been infringed on ATHETIC, please submit a written DMCA notice to our designated Copyright Agent at info@athetic.app including full identification of the copyrighted work and contact details.

6. Binding Individual Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY: YOU AND PRODIST LLC AGREE THAT ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION UNDER THE LAWS OF THE STATE OF FLORIDA, USA.
